Terms of Service

Last updated 15 August 2026

These Terms of Service ("Terms") govern your firm's access to and use of The Casebook (the "Service"), provided by The Casebook ("we", "us", "our"). By ticking the box at sign-up, or by accessing or using the Service, the firm ("you", "the Customer") agrees to these Terms. If you are agreeing on behalf of a firm, you confirm you are authorised to bind it.

Please also read our Privacy Policy and, where we process personal data on your behalf, our Data Processing Agreement, which form part of these Terms.

1.The Service and your workspace

The Service is an online subscription platform that helps consultant-solicitor firms manage matters, key dates, workflows, billing and invoicing. On sign-up we provision a private workspace for your firm at a subdomain of thecasebook.co.uk, together with a first administrator account.

You are responsible for the activity that takes place within your workspace, for keeping login credentials secure, and for the accuracy of the information you provide. Each person must use their own login; for security, a login may only be signed in from one active session at a time.

2.Authorised users and roles

You may add users ("Authorised Users") to your workspace and assign roles (such as administrator, billing or standard user). You are responsible for your Authorised Users' compliance with these Terms and for managing their access, including removing users who no longer require it.

3.Free trial

Where a free trial is offered, its length is shown at sign-up. No payment card is required to start a trial. Unless you cancel before the trial ends, your subscription continues automatically on a paid basis at the then-current price. We may modify or withdraw trial offers at any time.

4.Subscription, seats and fees

The Service is provided on a subscription basis. Fees are charged per seat — that is, per person with an active login — and you may add or remove users at any time; charges adjust accordingly. You choose a monthly or annual billing period, each with its own per-seat rate.

Unless stated otherwise, fees are exclusive of VAT, which is added where applicable. We may change our prices on reasonable notice; changes take effect from your next renewal, and your continued use after that constitutes acceptance.

5.Payment, renewal and non-payment

Subscriptions renew automatically at the end of each billing period until cancelled. Payments are collected through our payment provider, Stripe; by adding a card you authorise us to charge the applicable fees. We do not store your full card details — these are handled by Stripe.

If a payment is not made when due, we may send reminders and allow a grace period corresponding to your agreed payment terms. If the amount remains unpaid after that period, we may suspend or restrict access to the Service until the account is brought up to date. Except where the law requires otherwise, fees already paid are non-refundable.

6.Cancellation and term

You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period, and you retain access until then. Either party may terminate for material breach that is not remedied within a reasonable period after notice. On termination, your right to use the Service ends.

Following termination we will, for a limited period, make your data available for export, after which we may delete it in accordance with our Privacy Policy and Data Processing Agreement.

7.Acceptable use

You agree not to, and not to permit any Authorised User to:

8.Your data and data protection

As between you and us, you own the data you enter into the Service ("Customer Data"). You grant us a licence to host and process it solely to provide and support the Service.

Where Customer Data includes personal data that we process on your behalf, you are the data controller and we are the data processor. That processing is governed by our Data Processing Agreement. Our handling of the personal data for which we are the controller (for example account and billing details) is described in our Privacy Policy.

9.Intellectual property

We (and our licensors) own all intellectual property rights in the Service, including its software, design and branding. Subject to these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable right to access and use the Service during your subscription. You must not copy, modify, reverse-engineer or create derivative works from the Service except to the extent the law permits.

10.Availability, support and changes

We aim to keep the Service available and to provide reasonable support, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, and may add, change or remove features over time. Where a change materially reduces core functionality, we will give reasonable notice where practicable.

11.Third-party services

The Service relies on third parties such as Stripe (payments) and our email and hosting providers. Your use of those services may be subject to their own terms, and we are not responsible for their acts or omissions beyond our reasonable control.

12.No legal advice; your professional responsibility

The Service is a practice tool. It does not provide legal advice and is not a substitute for your own professional judgement. Deadline reminders and workflow prompts are aids only — you remain responsible for meeting your clients' deadlines, for the accuracy of your records, and for compliance with your regulatory and professional obligations.

13.Warranties and disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we exclude all implied warranties, terms and conditions not expressly set out in these Terms. Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded.

14.Limitation of liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited by law.

Subject to that, we are not liable for loss of profits, revenue, goodwill, or business, or for any indirect or consequential loss; and our total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the fees you paid to us for the Service in that period.

15.Confidentiality

Each party may receive confidential information from the other. Each party will keep the other's confidential information confidential and use it only to perform its obligations or exercise its rights under these Terms, except where disclosure is required by law or regulation.

16.Changes to these Terms

We may update these Terms from time to time. If we make a material change we will take reasonable steps to notify you (for example by email or an in-app notice). Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

17.General

You may not assign these Terms without our consent; we may assign them to an affiliate or successor. If any provision is found unenforceable, the remainder continues in force. A failure to enforce a right is not a waiver of it. Neither party is liable for failure or delay caused by events beyond its reasonable control. These Terms, together with the documents referred to in them, are the entire agreement between us regarding the Service.

18.Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
